Use of the Service

You will have access to the ACCERTIFIED.COM SERVICE ("the Service") as soon as you have registered for an account, paid for the Service, and we send you your login details.

You may not use the ACCERTIFIED.COM SERVICE in any way that harms Affiliate Classroom, Inc., or its affiliates, employees, strategic partners, content contributors, or customers. You agree to not disclose course content, including but not limited to written text, graphics, diagrams, videos, audios, and quiz, test, and examination questions and answers. Disclosure of ACCertified.com course content will be considered grounds for permanent revocation of earned course credits and permanent suspension of any credentials or certifications you have earned.

You are responsible for all activity within your account, and for keeping your account login and password secure. You may not share your login details with your employer, nor with anyone in your company, firm, agency, or network, nor with any outside company, firm, agency, or network. You may not share your login details with any merchant, whether contracted with you or your company, firm, agency, or network. You must keep your password secret, and promptly notify us via email or telephone as soon as you become aware of any security breach related to the Service.

You may not copy, resell, or redistribute any part of the ACCERTIFIED.COM SERVICE, unless you have been given permission to do so via written contract with Affiliate Classroom, Inc.

You may not link to the ACCERTIFIED.COM SERVICE from any unsolicited bulk email messages or unsolicited commercial email messages ("Spam").

All charges for training and certification are non-refundable unless expressly stated otherwise, or otherwise provided by law. We may cancel or suspend your account or certification if you violate these terms.

Non-Disclosure Agreement (NDA) and Copyright Notice

When you create an account with the ACCERTIFIED.COM SERVICE, you agree to not disclose course content, including but not limited to written text, graphics, diagrams, videos, audios, and quiz, test, and examination questions and answers, to any third party.

You may not share course content with your employer, nor with anyone in your company, firm, agency, or network, nor with any outside company, firm, agency, or network. You may not share course content with any merchant, whether contracted with you or your company, firm, agency, or network.

Disclosure of ACCertified.com course content to any third party will be considered grounds for permanent revocation of earned course credits and permanent termination of any credentials or certifications you have earned. Disclosure of ACCertified.com course content will also be considered a violation of copyright law, and of any other relevant intellectual property laws, and may result in legal action against you.

Privacy

To provide you with training and certification, we must collect certain information about you. That information is used and protected as described in the Affiliate Classroom, Inc. Privacy Policy, which you may review here: http://www.affiliateclassroom.com/privacypolicy.php

We may access or disclose information about you in order to comply with the law or respond to lawful requests or legal process, protect the rights or property of Affiliate Classroom, Inc. or our customers, including the enforcement of our agreements or policies governing your use of the ACCERTIFIED.COM SERVICE.

You consent to the transfer of personal information via the ACCertified Jobs System ("AC CERTIFIED JOBS")

We may use technology or other means to protect the ACCERTIFIED.COM SERVICE, protect our customers or clients, or to stop you from breaching these Terms of Use. Examples include filtering to stop viruses or to increase security. These means may make use of the ACCERTIFIED.COM SERVICE unavailable for a time.

Communications

Notices regarding your account, course status, and certificate status will be delivered in electronic form (email). Notices will be considered given and received on the transmission date of the email. As long as you can access and use the ACCERTIFIED.COM SERVICE, you are considered to have the means to receive email notices.

Any feedback you give to Affiliate Classroom, Inc. on your use of the ACCERTIFIED.COM SERVICE, you give to Affiliate Classroom, Inc. without charge, and you give Affiliate Classroom, Inc. the right to share and commercialize your feedback.

No Warranty

Affiliate Classroom, Inc., ACCertified.com, and the ACCERTIFIED.COM SERVICE Make no guarantee about the accuracy, reliability, or timeliness of the Service or results you may obtain from the Service. To the maximum extent permitted by law, Affiliate Classroom, Inc., ACCertified.com, and the ACCERTIFIED.COM SERVICE give no express warranties or guarantees. To the extent permitted by law, Affiliate Classroom, Inc., ACCertified.com, and the ACCERTIFIED.COM SERVICE exclude any implied warranties or conditions.

Liability Limitation

You can recover from Affiliate Classroom, Inc. direct damages up to an amount equal to your service charge. This remedy applies even if it does not fully compensate you for any losses, or fails its essential purpose.

To the extent permitted by law, you cannot recover any other damages from Affiliate Classroom, Inc. or ACCertified.com lost income, profits, special, indirect, or incidental damages. This limitation applies to the ACCERTIFIED.COM SERVICE, content, delays or failures you may experience in conducting or completing any electronic transmissions when using the ACCERTIFIED.COM SERVICE, and claims for breach of terms, breach of contract, breach of warranty, guarantee or condition, or negligence.

To the extent permitted by law, any claim related to the ACCERTIFIED.COM SERVICE must be made within one year. The one year period begins on the date when you could first file the claim. It you do not file the claim, then that claim is permanently barred.

Some jurisdictions do not allow the above exclusions or limitations, so they may not apply to you.

Affiliate Classroom, Inc. and ACCertified.com will not be liable for any loss or damage or be deemed to be in breach of this contract due to any event or circumstance beyond our control, including war, electrical outages, terrorist attacks, earthquakes, or acts of God.
